We consider the position of the gateway on Chew Hill is dangerous and advice from the Traffic Safety engineer should be sought.  We believe access could be via another field owned by the applicant that is adjacent to that part of Butham Lane which leads on to Chew Hill. We are concerned that hedgerow which was 30years old was removed to create the gateway, and that no effort was made to screen the new fencing to reduce the impact of the gateway on the openness of the Green Belt. We are also concerned that the field which is adjacent to the domestic curtilage of the applicant remains as a separate parcel of agricultural land.

My Council is equally divided on whether or not to support this application. We would ask that, as this proposals concerns development in the Green Belt and that the justification for this rather large mobile home is that it is necessary for the carrying out of an agricultural business, officers check to establish that the dwelling is related to the needs of the applicant to carry out an existing agricultural business, and that the requirements of Local Plan policy GB1 and HG10 are being met. Our concern is that the letter from the vet is dated May 2007 and the design statement is the same one as was submitted in February 2008, and that the applicant himself describes it as a” retirement home”.

The alterations to the main house, and the erection of a timber outbuilding set within the large grounds will not affect the openness of the Green Belt. We believe that changes to the front south facing elevation enhance the buildings appearance and therefore add to the character of the street scene in this part of the Conservation Area.

Chew Magna Parish Council supports this application as we are keen to promote measures which increase the sustainability and diversity of businesses within village centre, where opportunity is limited because of environmental and other factors We believe proposals to change the accommodation so that there is increased bed and breakfast space (which is lacking in the village centre) and a reduction of office premises (of which we have plenty) will assist in this aim. The changes are internal and therefore do not have an adverse impact on the amenity of properties or businesses in the immediate neighbourhood.

Chew Magna Parish Council supports this application. The proposed new dwelling though considerably taller is located more centrally within the plot which will reduce its impact on the amenity of properties in the immediate neighbourhood. The increase in height, although of some concern, is offset by the reduction in overall area of land covered by the building and therefore on balance will not increase harm on the openness of the Green Belt. We believe the new build is an improvement on the existing building and is more in keeping with the vernacular of the buildings in the Lane. We would wish to see traditional materials of red sandstone, render and timber used for cladding again to ensure that the new build is in keeping with the vernacular. We would wish to ensure that the new build is sustainable and are surprised there is no statement on energy sources/ usage as we believe all new build offers an opportunity to introduce energy reduction/ alternative energy source technology.

The present house is situated within and surrounded by a large curtilage and is well screened from neighbours by trees. Although the proposal is large we would argue that it is not disproportionate given the size of the site and the nature of the existing building which is a detached house largely surrounded by extensive gardens and set well back from the road.

The proposal is in keeping with the character of the dwelling itself and the surrounding area, which contains several similar large dwellings situated in their own substantial curtilages as exemplified by one of the adjacent properties.

We are aware of some concerns being expressed by owners of adjacent properties, but we do not believe there is a significant loss of amenity such that would warrant withholding support for the proposed extension.

We would like to draw the Council’s attention to appeal decision APP/FO114/A/08/2076067 made in September 2008 at the time when the “Existing Dwelling in the Green Belt” SPD was awaiting adoption and when the inspector was mindful of the Council generally using a guide figure of 30% for extensions. The favourable appeal decision was for an extension of 54% to a detached property in Chew Magna on a much smaller plot.

We would also draw the Council’s attention to the decision of the Development Control Committee in January 2006 to grant permission for an identical proposal for the same property. The Council by virtue of its decision must have determined that the proposal did not constitute inappropriate development in the Green Belt. We believe that National Planning Policy Guidance 2 Green Belt (from which the Green Belt policies in the Local Plan and SPD are derived) was last amended in March 2001. Therefore there have been no significant planning policy changes since the Council’s decision in 2006 to warrant refusal for this identical proposal.

I declare that Mrs Slade one of the applicants has been a Parish Councillor since 2007 but has not taken part in any discussion by the Parish Council or vote on the decision the Parish Council has come to regarding this response.

Chew Magna Parish Council supports the erection of the replacement business Unit 3 subject to improvements in the design and materials used. Whilst we can understand that it is more economic to replace the existing stone and clay tile building with one constructed from metal sheeting such a design on this side of the site is out of keeping with the two adjacent building on this historic industrial site, which can be viewed from the B3130 western side. We would like to see the replacement unit constructed to a similar design as used in rebuilding Unit 4 & 8 (05/00505/FUL) which better reflects the original character of the site and offers the opportunity to reuse material from the existing build.

Chew Magna Parish Council supports this application, as the reuse of agricultural buildings to provide business opportunity, encourage tourism and new homes is essential to preserving a sustainable rural community. We believe the construction on the existing footprint and in keeping with other renovated buildings on the site will not be detrimental to the Green Belt. However we believe that given the isolation of the site there needs to be adequate parking provision (for two or three cars) within the curtilage to accommodate visitors and to preserve the amenity of neighbouring properties.

For the protection of the amenity of the adjacent cottage the shared dividing wall between the two properties in the attic space, which is to be the new bedroom, should be brought up to the same standard and thickness as the other shared walls to provide adequate sound proofing
